Terms of Service

Please review the rules, policies, and legal terms for using StoneFjord Marketplace.

Welcome to StoneFjord Marketplace ("StoneFjord," "we," "our," or "us"). StoneFjord is an online marketplace that connects buyers and sellers of handmade goods, custom products, vintage items, and local services. By accessing or using StoneFjord, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the platform.

1. Eligibility

You must be at least 18 years of age to create an account or use StoneFjord. By accessing or using the platform, you represent and warrant that you meet this requirement. Users between the ages of 13 and 17 may use StoneFjord only with verifiable parental or guardian consent. StoneFjord reserves the right to terminate accounts found to be in violation of this requirement.

2. Marketplace Role

StoneFjord is a venue that enables independent buyers and sellers to connect and transact. We are not a party to any transaction between users. StoneFjord does not manufacture, inspect, or warehouse any goods, and does not employ or supervise any service providers listed on the platform. We make no representations or guarantees regarding the quality, safety, legality, or accuracy of any listing, and we are not responsible for the conduct of any user.

3. User Accounts

To buy or sell on StoneFjord, you must create an account with accurate, current, and complete information. You may only hold one account at a time unless expressly authorized by StoneFjord. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@stonefjord.com if you suspect unauthorized use of your account. StoneFjord will not be liable for losses resulting from unauthorized access due to your failure to secure your credentials.

4. Marketplace Structure

StoneFjord operates three primary modes:

  • Local Market — for the listing and sale of physical goods including handmade products, vintage items, collectibles, clothing, art, and more.
  • Local Services — for the listing and booking of in-person or remote services including home improvement, personal care, tutoring, creative services, and more.
  • Local Events — for listing and selling tickets to local events such as concerts, workshops, festivals, and community gatherings.

Additional rules, fees, or policies may apply to each mode and will be communicated in the relevant sections of the platform or in supplemental policy documents.

5. Listings & Content

Sellers are solely responsible for the accuracy of their listings, including descriptions, photographs, pricing, availability, and any claims made about a product or service. Listings must not be misleading, deceptive, or violate any applicable law. StoneFjord reserves the right to remove or modify any listing at any time, without prior notice, for any reason including suspected policy violations. Repeated listing violations may result in account suspension.

By posting content on StoneFjord, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content solely for the purpose of operating and promoting the platform.

6. Transactions & Payments

All transactions on StoneFjord are conducted directly between buyers and sellers. StoneFjord facilitates payment processing but does not guarantee that a buyer will complete payment or that a seller will fulfill an order. Payment is processed at the time of purchase. Funds may be held in escrow until the buyer confirms receipt or a defined fulfillment period expires. Sellers are responsible for accurately calculating and collecting any applicable taxes. StoneFjord is not responsible for tax compliance on behalf of users.

7. Fees

StoneFjord may charge the following fees, subject to change with 30 days' notice:

  • Seller platform fee — a percentage of the sale price deducted from the seller's payout; the rate varies by vertical (Local Market, Local Services, Local Events).
  • Buyer platform fee — a flat percentage added to the buyer's total at checkout, consistent across all verticals.
  • Listing fee — a non-refundable one-time fee charged to publish a listing on the platform.
  • Promotion subscription — an optional recurring monthly fee to feature a listing in promoted placements.

StoneFjord pays payment-processing costs out of its own platform fee; those costs are not passed through to buyers or sellers as a separate charge. Current rates for all fees are published on the Help Center fee page. Fees owed to StoneFjord remain due even if an account is suspended or terminated.

8. Refund & Dispute Policy

This section reflects our interim refund policy and may be updated as self-serve dispute tools are introduced.

Sellers set their own refund terms, which are displayed to buyers before purchase. Those seller-set terms govern most transactions.

Regardless of seller terms, StoneFjord requires a refund in the following cases:

  • (a) An item is not received or is materially not as described.
  • (b) An organizer cancels a Local Event, in which case all ticket holders are refunded the full ticket price.

When an organizer cancels a Local Event that had paid ticket sales, StoneFjord charges the organizer a cancellation fee of $25 plus 5% of gross ticket sales, capped at 50% of gross ticket sales. This fee is charged to the organizer's saved payment method and is separate from the buyer refunds, which are always issued in full.

To request a refund under (a), report a problem directly from your order in your StoneFjord account within 30 days of purchase, or contact support@stonefjord.com. StoneFjord support reviews each report and, where the claim is valid, issues a refund to the original payment method.

The one-time listing fee and any promotion subscription fee are non-refundable. Refunds, where issued, are returned to the original payment method. StoneFjord reserves the right to cancel any transaction that violates these Terms.

9. Intellectual Property

All content you upload to StoneFjord — including photos, descriptions, logos, and digital files — must be your original work or content you have the legal right to use and distribute. You represent and warrant that your content does not infringe the intellectual property rights of any third party.

For custom or commissioned work, ownership of the final deliverable passes to the buyer upon receipt of full payment, unless a separate written agreement specifies otherwise. StoneFjord does not verify uploaded content for copyright or trademark compliance and will not be liable for infringement claims arising from user-submitted content. We will respond to valid DMCA takedown notices in accordance with applicable law.

10. Prohibited Items & Activities

The following are strictly prohibited on StoneFjord:

  • Illegal goods or services of any kind
  • Counterfeit, replica, or unauthorized reproductions of branded goods
  • Controlled substances, drugs, or drug paraphernalia
  • Weapons, firearms, ammunition, or explosive materials
  • Alcohol or tobacco products (unless explicitly permitted by StoneFjord in writing)
  • Adult content, sexually explicit material, or services of a sexual nature
  • Hazardous materials or items that pose a risk to health or safety
  • Stolen property or goods obtained through fraudulent means
  • Spam, misleading listings, or coordinated manipulation of reviews or ratings
  • Any activity that violates local, state, federal, or international law

StoneFjord reserves the right to expand this list at any time. Violations may result in immediate removal of listings and suspension of your account.

11. Acceptable Use Policy

You agree not to use StoneFjord to harass, threaten, or defraud other users; to scrape, crawl, or systematically extract data from the platform; to circumvent security measures or access areas of the platform you are not authorized to use; or to interfere with the platform's normal operation. You also agree not to attempt to establish direct financial relationships with users you met through StoneFjord for the purpose of avoiding platform fees, for a period of 24 months following your last transaction with that user on StoneFjord.

12. Enforcement & Account Suspension

StoneFjord uses a progressive enforcement system:

  • First violation — written warning and listing removal.
  • Second violation — temporary account suspension (duration at StoneFjord's discretion).
  • Third violation — permanent account termination.

StoneFjord reserves the right to skip any step of this process and proceed to immediate permanent termination for serious violations, including but not limited to fraud, illegal activity, or repeated intellectual property infringement. Terminated users may not create new accounts without express written permission from StoneFjord.

13. Disputes Between Users

StoneFjord encourages buyers and sellers to resolve disputes directly and in good faith. While StoneFjord may provide mediation tools or customer support assistance, we are not obligated to intervene in or arbitrate disputes between users. Any legal claim arising from a transaction between users must be brought against the other party, not StoneFjord. By using the platform, you release StoneFjord from any and all claims arising out of disputes with other users.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STONEFJORD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

In no event shall StoneFjord's total aggregate liability to you for any claims arising out of or related to these Terms or your use of the platform exceed the greater of (a) the total fees paid by you to StoneFjord in the six months preceding the claim, or (b) $100 USD.

15. Indemnification

You agree to defend, indemnify, and hold harmless StoneFjord and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the platform; (b) your listings, content, or conduct; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property rights.

16. Termination

You may close your account at any time by contacting StoneFjord support. StoneFjord may suspend or terminate your account at any time, with or without notice, for any reason including violation of these Terms. Upon termination: (a) your right to use the platform immediately ceases; (b) any outstanding fees remain due and payable; (c) StoneFjord may remove your listings and content from the platform; and (d) provisions of these Terms that by their nature should survive termination will continue to apply, including Sections 9, 14, 15, and 19.

17. Privacy

Your use of StoneFjord is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. StoneFjord does not sell your personal data to third parties. We may share data with service providers and payment processors as necessary to operate the platform.

18. Changes to Terms

StoneFjord reserves the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting updated Terms on the platform and, where possible, notifying you via the email address on file. Your continued use of StoneFjord after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the platform and close your account.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts.
